Tato bakalářská práce nazvaná „Transparentnost uskutečnění zdanitelného plnění a daňová povinnost k DPH‘‘ se zabývá problematikou stanovení data uskutečnění zdanitelného plnění a současně stanovením data uskutečnění plnění u všech subjektů podléhajících této dani. Práce je rozdělena do dvou částí. V první části se nachází vymezení některých problematických pojmů zákona o dani z přidané hodnoty, legislativa upravující tuto daň z pohledu Evropské unie a nakonec je uveden přehled vývoje novelizací zákona od jeho faktického vstoupení v platnost v květnu 2004. V druhé části, členěné dle jednotlivých ustanovení zákona o DPH, je podrobně vysvětleno stanovení data uskutečnění zdanitelného plnění při obchodech na území České republiky, při dodání zboží do jiného členského státu, při dovozu zboží, při poskytnutí služby osobou registrovanou k dani v jiném členském státě a zahraniční osobou, při poskytnutí služby s místem plnění mimo tuzemsko a při pořízení zboží z jiného členského státu.
This bachelor work which is called „Transparency of chargeable event and chargeability of VAT‘‘ is concerned with the questions of setting the date of chargeable event and setting the date of non-chargeable event at the same time for all the kinds of taxable persons. This work is devided into a few parts. In the first part there you can find definitions of some of the problematic concepts from the law on value added tax, then there you can find legislation regulating this tax from the view of the European Union. At the end of this first part you can find a scan of the history of amendments of act since it has entered into force in May 2004. In the second part, which is structured in accordance with separate provisions of law, there is in detail explained setting the date of chargeable event in case of trades on the territory of the Czech Republic, in case of supply of goods to another member state, in case of importation of goods, in case of supply of services by a person registrated in other member state and foreign person, in case of supply of services with the place of supply out of the territory of the Czech republic and in case of acquisition of goods from another member state.
