Churches and religious societies in the Czech Republic exist independently
of the state. For obtaining legal entity status, a church must be registered in an
administrative procedure stated in the Act on Religious Freedom and the Position
of Churches and Religious Associations (No. 3/2002 Coll.) valid from January the
7th, 2002. Between the years 2002 and 2006, eight religious bodies applied for
registration. Three of these applications were not successful. In this study, the
reasons for these failures are described.
In 2002, the Ecumenical Church of Saint John of Jerusalem, the Order of
the Knights of Rhodos and Malta, applied for registration. Ministry of Culture,
the state organ responsible for such registration, found out a lot of discrepancies
in the application. In the process of negotiations, the preparatory committee of the
church retracted the application. In 2003, the Ministry of Culture denied the
application of the Ukrainian Greek Catholic Church, because the church was not
properly constituted according to canonical law and because the application was
based on insufficient supporting signatures. In 2004, the Jewish Center Chai
applied for registration. It was denied because its application did not meet the
appropriate legal conditions. The Center did not have the required number of
signatures and some signatures were falsely placed on the document.
Studying the reasons of these unsuccessful applications proves that in these
three cases, the Ministry of Culture did not infringe religious freedom as provided
for in the Czech Constitution. |
